What are my rights against ACS?
Unless ACS has a court order or search warrant, you have the right to refuse to speak to ACS or allow them into your home. This will not stop the investigation and may make it worse. ACS may talk to your children at school, your children’s teachers, service providers, and doctors.
Can relatives become foster parents?
Foster/Adopt Parent Concurrent caregivers can be relatives or non-relative foster parents who provide foster care for children while reunification services are provided to the child and his or her birth parents.
Can a child choose to live with an aunt?
Not in the custody case, no, the judge cannot grant custody to your aunt. As for choosing where you want to live, you are at an age where a judge may listen to what you want; that does not mean that the judge will do what you want.
Can ACS take my child?
If your caseworker and the supervisor determine that no safety interventions can be put in place to eliminate the imminent danger to your child, ACS will seek a Family Court order to remove your child and place your child into foster care.
Can I find out who called ACS on me?
These reports are anonymous and information cannot be disclosed. Unfortunately sometimes this gets abused but they must do it to insure reports especially in true cases…
Can a court give custody of a child to an aunt?
In this case, the state law may require that the child be placed in foster care. Before doing so, the court may consider giving custody to an aunt or uncle, if they can meet the conditions set by the court.
Do you have legal rights to aunts and uncles?
However, usually there are not legal rights for custody for aunts and uncles. Parents are deemed to be the legal guardians of the child for making decisions in their best interests. There may be a few exceptions if there is neglect, abuse, or danger to the child while living with the parents.
Can a parent get custody of a child and not the child?
In some situations, neither parent gets custody of the children, and they are placed into foster care or with another family member, such as an aunt or uncle. Custody of a child has two aspects – legal and physical. Having a right to visit with a child is not the same thing as having custody of that child.
Can an aunt or uncle get temporary guardianship of a child?
Parents in life-threatening situations can grant temporary guardianship over the children through the proper legal documents. This can give the aunt or uncle custody of the child during the parent’s absence or in case of their death. Some examples include: A person with illness and undergoing radiation or chemotherapy treatments.
